Description of the assignment: Justice Specialist
Period of assignment: 90 days of work in Yangon and 30 days of home-base work (Please see TOR)

Any request for clarification must be sent in writing, or by standard electronic communication to the address or e-mail indicated above. Procurement Unit will respond in writing or by standard electronic mail and will send written copies of the response, including an explanation of the query without identifying the source of inquiry, to all consultants.
1. BACKGROUND
In accordance with the Country Programme Action Plan signed between the Government of the Republic of the Union of Myanmar and the UNDP in April 2013, the UNDP has commenced programming across four areas of democratic governance, including the rule of law and access to justice. The development of rule of law and access to justice programming in three focus areas (Mandalay Region, Shan State, and Ayeyarwady Region) will build on ongoing collaboration at the central level of the Supreme Court and Attorney General's Office, and also benefit from a mapping exercise currently underway that will conclude in December 2013. An expert in the area of access to justice and rule of law is required to assist in developing programming that will be initiated in 2014 and continue through at least 2015. This will include leading and managing the programme on Clinical Legal Education in Myanmar, supporting the work related to better equipping the justice sector actors and legal empowerment in state/regions, particularly in Shan, and supporting the Rule of Law Specialist in planning and managing UNDP support to the counterparts.
2. SCOPE OF WORK, RESPONSIBILITIES AND DESCRIPTION OF THE PROPOSED ANALYTICAL WORK Please see TOR attached.

4. DOCUMENTS TO BE INCLUDED WHEN SUBMITTING THE PROPOSALS Interested Individual Consultant must submit the following documents/information to demonstrate their qualifications:
1. Proposal: (i) Explaining why the consultant is the most suitable for the work (ii) Provide the methodology on how the consultant will approach and conduct the work 2. Financial proposal 3. Personal CV including past experience in similar assignments carried out for other organizations and at least 3 references
5. FINANCIAL PROPOSAL
Fees The financial proposal shall specify the consultancy fees and all costs in relation to the scope of work of the consultancy.
Travel All envisaged travel costs must be included in the financial proposal. This includes all travel to join duty station/repatriation travel. In general, UNDP will not accept travel costs exceeding those of an economy class ticket. In the case of unforeseeable travel, payment of travel costs including tickets, lodging and terminal expenses shall be agreed upon, between the respective business unit and Individual Consultant, prior to travel and will be reimbursed. 6. EVALUATION
Individual Consultants will be evaluated based on the following methodology. Cumulative analysis The award of the contract shall be made to the individual consultant whose offer has been evaluated and determined as:
- Responsive/compliant/acceptable, and
- Having received the highest score
- Technical Criteria weight; 70%
- Financial Criteria weight; 30% Only candidates obtaining a minimum of 70 points in the technical evaluation will be considered for the Financial Evaluation

Terms of Reference
Justice Specialist
Duration of the Contract: 120 working days over the following period (duration of Contract): 20 December 2013 to 31 July 2014. Estimated 90 days of work in Yangon and 30 days of homebased work.
Duty station: Yangon. Travels to capital and state/regions involved. International travel may be needed.
A. Background

B. Deliverables
The justice specialist will provide technical and policy advice on Clinical Legal Education, proposed Rule of Law Centres, UNDP support on policing, and support the Rule of Law Specialist in preparing communication materials, editing reports and strengthening capacities of national staff. The specific deliverables are:
1. Clinical Legal Education (approx. 30 days). The Consultant will:
1.1 Carry out discussions and provide feedback to the contractor/professional agency selected by UNDP to implement the CLE project in Myanmar with a view to ensure that the final design is technically sound, feasible in terms of implementation on the ground and in line with the rest of the UNDP Rule of Law and Access to Justice Programme
1.2 Liaise with the Ministry of Education and universities to ensure their understanding of the CLE programme in Myanmar and secure their buy-in and support in implementing the programme
1.3 Provide technical advise and editing support to the selected contractor/ professional agency in producing quality UNDP communication materials including success stories, reports and press release for website
1.4 Provide ongoing technical advice to the selected contractor/ professional agency to ensure smooth running of the Programme
2. Rule of Law Centres (approx. 40 days). The Consultant will contribute to the feasibility study (facilitated by UNDP) on the possible role and scope of the justice centres in Myanmar. In particular, s/he will: 2.1 Produce an options paper on the role and scope of the Rule of Law Centres with respect to legal aid and their linkages with the Myanmar Police Force. 2.2 Advise on and provide written recommendations on the implementation strategy for the Rule of Law Centres including on risks and budgets (2 pages maximum)
3. UNDP Support for improved policing (approx. 30 days). Based on UNODC's police assessment, UNDP's justice mapping and the proposed feasibility study on rule of law/justice centres, the consultant will: 3.1 Liaise with UNODC and the Myanmar Police Force with a view to ensure an integrated sectoral approach to police reform 3.2 Develop an options paper for UNDP's work with the Myanmar Police Force 3.3 Provide ongoing technical advice on implementing UNDP activities on police reform
4. Support to the RoL Specialist (approx. 20 days). The consultant will 4.1 Draft communication products (including for website) and reports for counterparts (progress reports, success stories) 4.2 Support the Rule of Law Specialist in the preparation of ToRs and procurement of goods and services for counterparts
C. Deliverables and schedule of payment
D. Institutional Arrangements The Justice Special will report directly to the Rule of Law Specialist on a regular basis, who will supervise her/his work. The Justice Specialist will be expected to work closely with the UAGO, OSCU, police, and CSOs in Myanmar.
E. Qualifications
1. Master's degree in Law. Qualified lawyer possessing a Master's Degree in Law.
2. Knowledge and experience related to specific target groups. At least 10 years' experience of working with government ministries, civil society organisations and vulnerable groups on issues relating to police reform, legal aid, legal empowerment, clinical legal education and access to justice.
3. Regional experience. Specific experience in South Asia and/or Southeast Asia in each of the substantive areas including legal empowerment, legal aid, police reform, clinical legal education and access to justice. Prior experience of working in Myanmar on these issues is highly desirable.
4. Management Experience. Demonstrated ability to manage programs and to lead teams dedicated to justice sector reform. Prior experience of managing UNDP projects is highly desirable.
F. Further requirements
All proposals must be expressed in one of the following pricing options:
1. Daily Fee
a. The Daily fee must be 'all-inclusive'1; and
b. An IC Time Sheet must be submitted by the Contractor, duly approved by the Individual Contractor's supervisor, which shall serve as the basis for the payment of fees.
c. Indicate how you want to go about cost for travel
2. Lump Sum Amount
a. The lump sum amount must be 'all-inclusive'2;
b. The contract price is fixed regardless of changes in the cost components;
c. In the initial payment the actual cost of the IC's travel to arrive at the designated Duty Station will be paid.
The following documents are requested:
1) Email indicating confirmation of interest and availability;
2) Personal CV or P11, indicating all past experience from similar projects, as well as the contact details (email and telephone number) of the Candidate and at least three (3) professional references;
3) Financial Proposal (If the proposal is expressed in the form of a lump sum amount, indicate the all-inclusive fixed total contract price, supported by a breakdown of costs.) If an Offeror is employed by an organization/company/institution, and he/she expects his/her employer to charge a management fee in the process of releasing him/her to UNDP under Reimbursable Loan Agreement (RLA), the Offeror must indicate at this point, and ensure that all such costs are duly incorporated in the financial proposal submitted to UNDP.
Criteria for selection: Combined Scoring method – where the qualifications and methodology will be weighted 70%, and combined with the price offer which will be weighted 30%
