Background
Myanmar is at an historic stage in its development. A new Constitution was adopted in May 2008 and elections were held in November 2010 with bi-elections in April 2012. Parliament and governments have been formed at the national and region/state levels. A number of reforms have already been undertaken focusing on good governance, human rights and reaching cease-fire agreements in a number of conflict areas. These reforms are seen as positive steps, which have led to increasing engagement with the international community and allowed Executive Board of UNDP to lift mandate restrictions and to propose a fully-fledged UNDP country programme. Against this rapidly changing background, UNDP Myanmar is undergoing strategic repositioning and ramping up its capacities in order to effectively support national priorities of democratic transformation and poverty reduction. After more than 20 years of working exclusively at the grassroots level through the Human Development Initiative, the draft country programme for Myanmar (2013-2015) envisages contributions towards strengthening democratic governance, provision of policy advice for poverty reduction, strengthening resilience against climate change and disaster risk reduction, and targeted support for strengthening institutions of local governance. In this context, Pillar 3 of the country programme addresses support to democratic governance, with four outputs including in particular an output on Rule of Law and Access to Justice as follows:
  • Strengthened institutional capacity of the justice sector to formulate, implement; and coordinate a comprehensive (nationally-owned, multi-stakeholder, gender-responsive and rights- driven) policy and strategy for the justice sector;
  • Enhanced capacity of justice actors for the development of a justice system that upholds the rule of law, protects human rights, promotes gender equality and improves access to justice, including through laws and regulations that are in conformity with the Constitution and international human rights standards. Increased service delivery at the local level focusing on the rights of women and the rights of the most marginalized, in target States/Regions and in selected townships;
  • Empowerment of women and marginalized groups in selected pilot States/Regions to claim and have their rights adjudicated and grievances remedied;
  • Ethnic groups in cease fire and border areas have increased knowledge of their rights and are better able to access and benefit from expanded justice remedies.
Under direct supervision of the Rule of Law Specialist and under technical direction from the Chief Technical Advisor for Rule of Law and Access to Justice, the Programme Analyst (RoL) is responsible for support to the implementation of activities under Output 3 of Pillar 3 of the Country Programme and in particular for maintaining, bringing existing relations to another level and/or establishing new relations with justice actors, most notably the Union Attorney General's Office and the Office of the Union Supreme Court. Furthermore the incumbent will be responsible for providing input to this Programme bases on knowledge of and experience with Myanmar law. The Programme Analyst (RoL) will contribute to promoting coordination and close collaboration with other outputs of Pillar 3 (parliament, public administration, development planning), and other relevant parts of the Country Programme (in particular local governance). The incumbent will report directly to the Rule of Law Specialist and will work closely with the Chief Technical Advisor on Rule of Law and Access to Justice. The post carries the following key functions:
  • Support with the programme design, development and implementation, including identifying approaches and modalities to achieve development targets;
  • Provide updated information and analysis of the political developments with specific focus in relation to national counterparts within the Justice Sector.
Duties and Responsibilities

Under the direct supervision of the Rule of Law Specialist, and acting in close coordination with and taking technical leadership from the Chief Technical Advisor for Rule of Law and Access to Justice, the Programme Analyst (RoL) provides strategic coordination and implementation in the programme area of Rule of Law and Access to Justice (ROL/A2J):
Technical Myanmar law advice
  • Contributes to the design, monitoring and evaluation of the ROL/A2J programme;
  • Support the implementation of justice assessments both at Union as well as at state/regional level.
Capacity Development
  • Supports the assessment of the impact and effectiveness of UNDP's ROL/A2Jprogramme in Myanmar;
  • In particular, supports building the capacity of national stakeholders for inclusive and participatory coordination, planning and policy making in the justice sector and for an inclusive and participatory legislative review process;
  • Supports the implementation of the overall strategic vision of ROL/A2J with a view to building national capacities, establishing the rule of law and enhancing security;
  • Provides effective supervisory role to national/international consultants working on specific activity results- if applicable.
Coordination and Information sharing
  • Supports the organization of Advisory Committee meetings held by the Union Attorney General's Office and/or the Office of the Supreme Court of the Union- if applicable or to any other coordination. Information sharing meetings at the NPT level;
  • Promotes joint programming and UN refrom, and collaborated effectively in setablished frameworks for UN and other international coordination.
Relationship building with national counterparts
  • Supports the ROL/A2J programme Team in networking to ensure a programme which is relevant for national counterparts and responsive to changes in the country context;
  • Contributes to the harnessing of effective partnerships and competitive selection of partners for implementation of UNDP projects.
Any other tasks as assigned by the Rule of Law Specialist/or the Chief Technical Advisor for Rule of Law and Access to Justice.
The key results have an impact on the overall success of the country programme and reaching CPD and project document goals. In particular, the key results have an impact on the design, operations and programming of activities, creation of strategic partnerships as well as reaching overall project targets.

Required Skills and Experience
Education:
  • Bachelor's degree in Law, development, management or other relevant fields.
Experience:
  • At least 4 years of relevant experience at the national or international level in providing legal advice, and hands-on experience in design, monitoring and evaluation of development projects;
  • Experience in the use of computers and office software packages and handling of web based management systems.
Language Requirements:
  • Fluency in English (both writing and speaking) and Myanmar.
