Background

Under the supervision of the Head of Rule of Law, the National Legal Officer promotes the rule of law and human rights in hate crimes, war crimes, trafficking in human beings, and other major crimes as well as broad justice sector reform. She/he works in OSCE Head Office and bears the responsibility for his/her thematic portfolio covering whole BiH. The National Legal Officer actively monitors, investigates and reports on rule of law issues and problems pertaining to her/his portfolio and identifies structural deficiencies with the aim of developing strategic interventions and departmental policies. The incumbent intervenes with national authorities and advocates for the creation of policies and legislation that would enhance the realization of fair trial rights and respect for rule of law in compliance with European and international human rights standards;
Tasks and Responsibilities
- Analyzes and advises on implementation of criminal legislation at all levels in BiH;
- Works with governmental authorities, international organizations and NGOs to develop human rights compliant policies on justice sector issues; represents the Department at rule of law and justice sector related meetings or conferences with other international organizations, government officials, civil society, OSCE Delegations etc;
- Reviews legislation to identify provisions which conflict international human rights standards; identifies gaps in legislation, policy and practice which impact on fair trial rights related to criminal proceedings;
- Works with governmental authorities, public institutions, international organizations and NGOs to identify sustainable solutions identified gaps in legislation and implementation of the rule of law;
- Co-ordinates and advises on justice sector issues related to the work of the rule of law section staff in the field;
- Monitors the drafting of new legislation and policies, where appropriate;
- Suggests intervention strategies where necessary and follows up on rule of law issues; Meets with national authorities on legal reform projects and policy strategies;
- Reports on rule of law issues including Departmental reports, Mission bi-weekly reports, spot reports, etc.;
- Other duties as assigned.
Necessary Qualifications
- University Degree in Law or related field of studies;
- Minimum of 2 years professional experience in rule of law related area in national or international set up;
- Good/demonstrable analytical skills;
- Established knowledge of BiH and international criminal law issues and of European and international human rights conventions;
- Computer literate with practical experience in Microsoft applications;
- Excellent written and oral communication skills in English and in the local languages;
- Ability to work with people of different nationalities, religions and cultural backgrounds;
- Demonstrated gender awareness and sensitivity, and an ability to integrate a gender perspective into tasks and activities;
- Holding a valid driving license.
