TERMS OF REFERENCE
BACKGROUND
The Independent Consultation and Investigation Mechanism (ICIM) was created and its policy approved by the Bank's Board of Executive Directors in February, 2010. This ICIM Policy establishes an independent forum and process to address complaints from communities or individuals who allege that they are or might be adversely affected by IDB-financed operations due to a potential non-compliance by the Bank of its operational policies.
The ICIM is a reflection of the IDB's institutional commitment to accountability, transparency and effectiveness. The Mechanism reports directly to the Board of Executive Directors (the "Board") and is independent from the IDB's Management.
The ICIM Policy envisages a two-phase sequential process. The first Phase is the Consultation Phase, a process conducted by the Project Ombudsperson involving consensual methods of addressing the concerns of a Requester. The second Phase is the Compliance Review Phase, which involves a formal investigation of whether actions or omissions of the Bank in connection with a Bank-Finance Project violated its own Relevant Operational Policies. The Compliance Review investigation is conducted by the Chairperson and two other Panel members that results in a Compliance Review report for the Board.
In this context, the ICIM is seeking to incorporate into its Compliance Review Team two Defined-Term Consultants to assist the Panel as Case Officers.
Consultancy Objectives
Each Case Officer will assist the Compliance Review Panel within the ICIM with a focus on undertaking research activities related to Requests in the Compliance Review Phase in support of the Panel's analytical and investigative process as well as drafting of relevant sections of required memoranda and reports issued by the Panel for each of the Requests in their case portfolio.
Main Activities
Reporting to the Panel Chairperson, working under the day-to-day supervision of the Executive Secretary, each Case Officer will support the case management operation of the Compliance Review Panel, including the following main activities
Ø Support the Panel Chairperson and other Panel Members as required, in connection with Requests for Compliance Reviews, including defined research tasks, and provide inputs into eligibility determinations, Recommendations for Compliance Reviews and TORs, and Panel Reports.
Ø Review, organize and synthesize information relating to Requests for Compliance Reviews, including information relating to:
- IDB-financed Operations for which Requests have been filed,
- Bank Relevant Operational Policies ("ROPs") (that is, relating to the social and environmental performance of Projects),
- Information and documents supplied by Requesters with respect to Requests,
- Summaries and pleadings regarding pending litigations or arbitrations.
Ø Assist with communications with Requesters, Management and other stakeholders in connection with the Compliance Review Phase in close coordination with the Executive Secretary.
Ø Assist in updating of relevant case information and documenting of processes as per ICIM standards and guidelines.
Ø Ensure consistency of Compliance Review documents with ICIM and Bank standards
Ø Provide research and coordination support to Panel members and other consultants engaged by the Panel.
Ø Consult with the Executive Secretary and other members of the ICIM staff for administrative matters.
Ø Accompany and support other Compliance Review Panel activities/tasks as assigned by the Panel Chairperson.

Competencies
Technical Expertise: In-depth knowledge of development, social and environmental sustainability issues. Experience in public and private development - financing is a plus.
Teamwork: Demonstrated ability to take initiative to assist others; experience with sharing knowledge, experiences and information; ability and skill at expressing divergent viewpoints productively and tactfully and to work proactively and respectfully toward effective resolutions of issues.
Initiative and Adaptability: Ability to act independently and resourcefully in responding to work demands; ability to adjust to multiple demands, shifting priorities, ambiguity and change.
Communication: Ability to convey facts and ideas clearly and in an organized manner in writing and verbally. Skill and empathy to listen to others' points of view; ability to synthesize information and produce meaningful summaries of information in reports and otherwise.
Building Bonds: Ability to proactively cultivate networks with people across a variety of cultures, processions/training functions and locations within and outside the Bank. Work effectively and cooperatively with all stakeholders.
Integrity and Ethics: Comfortable working in pressured environment with issues of ethics and integrity at forefront of work.
Education: Master's degree (or similar academic level) in Law, Environment, Anthropology or Sociology preferred with experience in the field of sustainable development, especially from a public/private sector perspective. Legal training and practice in development and financing an asset.
Experience: Minimum 5 years of experience in development projects with a focus on social and environment issues and practice standards and understanding of development finance. Ability to analyze complex fact and documentary issues and write clear and precise analytical documents and to adapt communication to different audiences; demonstrated ability to contribute to multidisciplinary and multicultural project teams; experience in working independently and coordinating electronically/at a distance through available technologies with supervisors.
Languages: Proficiency in English and Spanish; working knowledge of Portuguese a plus. Strong English writing and editing skills beneficial.
Payment and Conditions of Employment
The work will be carried out at Bank headquarters in Washington D.C. Remuneration will be determined commensurate with years of experience and Bank regulations and consultant criteria. The Bank will additionally contribute toward travel and moving expenses, if applicable. If a candidate is not a citizen or resident of the United States, the Bank will apply for a G-IV visa from the consulate of the United States in the candidate's country of origin. If a candidate cannot obtain a visa to work at the IDB the contractual offer will be rescinded.
Consanguinity: Individuals with relatives working for the IDB within, and including the fourth degree of consanguinity and the second degree of affinity are not eligible for employment as staff, consultants, or contractors through firms or agencies. Candidates must be citizens of a member country of the Inter-American Development Bank.
