Background
The Royal Government of Bhutan has requested GEF assistance through UNDP for the preparation of a project proposal for a medium sized project: 'Implementing the Nagoya Protocol on Access to Genetic Resources and Benefit Sharing in Bhutan'. The project aims to put in place the national framework for ABS in Bhutan which is compliant to the provisions of the Nagoya Protocol. The project will enable smooth and successful agreements on different products from Bhutanese genetic resources, ensuring full compliance with the provisions of the Nagoya Protocol. The project will enable Bhutan to achieve ratification and implementation of the Nagoya Protocol, upgrading the Bio-prospecting Programme and the laboratory as well as technical and legal capacities to carry out isolation and identification of bio-active compounds, legal expertise to enter into negotiations and execute ABS agreements, and develop community protocols and capacities to enter into ABS negotiations.
Duties and Responsibilities
The consultant will carry out the following tasks:
- In close collaboration with the lead national specialist, conduct legal and institutional review for establishing ABS implementation framework to operationalize the Policy and recommend interventions in the project design based on international best practices – to improve policy decision making and on the ground implementation of conservation, sustainable use and fair and equitable sharing of benefits;
- Undertake capacity assessment of project implementers and stakeholders applying the ABS Capacity Scorecard, and identify strategic areas of support for the project intervention;
- Facilitate national level workshop amongst project stakeholders to identify potential national/international partners to pilot ABS agreement that is compliant with the Nagoya Protocol;
- Provide technical support for developing the pilot component, including a preparatory analysis of viable ABS agreements to be established with support of the project and potential bio-discovery pilots to be supported by the project;
- Provide technical review and input to the project document / CEO document, as well as for official response to the GEF Secretariat's review comments.
Competencies
Functional Competencies:
- Ability to undertake capacity assessment applying the ABS Capacity Scorecard;
- Demonstrate ability to conduct legal and institutional review for establishing ABS implementation framework based on international best practices;
- Ability to take initiative and to work independently, as well as part of a team, and to adapt to various situations.
- Demonstrate knowledge of project development and proven record of projects developed under Biodiversity Focal Area with specific reference to ABS.
Required Skills and Experience
Education :
- Master's or higher degree in biodiversity, environmental science, NRM and allied subjects related to the expertise areas.
Experience:
- Extensive international experience in developing ABS framework/policy/agreement, including policy and legal analysis required.
Language:
- Good communication and writing skills in English language.
