NOTE: This position will be based in the World Bank's Jakarta, Indonesia Office for the duration of the one-year Term appointment
1. Justice for the Poor (J4P) is an analytical and operational program with the following objective: To influence the theory and practice of development in contexts where engaging with legal pluralism presents a central challenge to promoting equity and managing conflict. The program was developed in partnership with AusAID in order to define and test alternative approaches to justice reform that focus on deep engagement with social and political processes and a wider range of state and non-state institutions, and to leverage the multidisciplinary and cross-sector reach of the Bank and the regional expertise of AusAID to 'inform and enhance the effectiveness of justice sector and broader sectoral and governance programming supported by both organizations.'
2. The objective of the J4P program in Indonesia is to strengthen access to justice for poor and marginalized communities in Indonesia. Since 2002, the program has been supporting bottom up approaches to justice reform and exploring which factors enable poor village communities to defend their rights successfully in an environment of institutional weakness. It has provided operational support to build legal awareness at the community level, increased access to legal aid resources, mediation and organization skills and resources to link poor communities to a network of assistance at higher levels across 11 provinces in Indonesia. The operational activities are linked to analytical outputs that support empirically based policy development at the national level. J4P also works closely with other World Bank supported programs, including the National Community Empowerment Program (PNPM) and programs which aim to improve service delivery to communities, to support greater integration of justice, accountability and local level governance issues in development processes.
3. PNPM continues to sit at the core of the Government of Indonesia's poverty reduction and community empowerment efforts. The program started as the Kecamatan Development Program (KDP) in 1998, and in 2006 the Government announced that it would expand to cover the entire country. This nearly four-fold scale up happened from 2006 - 2009, and PNPM now has national coverage and disburses USD 1.3 billion per year. However, management and oversight functions have struggled to keep pace with this dramatic expansion. In addition, because the program has been operating within communities for so long, it is accumulating increasingly large financial assets. The combination of these factors is resulting in increasing governance challenges for the program. At the same time that the program faces these internal challenges, it is under increasing pressure to support broader accountability efforts at the local level.
4. Officially, it is estimated that under one percent of PNPM's budget is lost in corruption in other leakage, however the actual figure is likely to be higher. PNPM cases have generally been characterized by involving small amounts of money, though more recently there have been more cases involving larger amounts of funding. However, even small amounts of corruption in PNPM may have a broader negative impact through undermining the program's intention to change local norms about the importance of participation and accountability.
5. While the program has an operational complaints handling system, it is clear that communities need both additional support to effectively oversee the funds that they secure through PNPM and, in the instances where larger amounts of money is taken, pursue the case into the formal legal system. J4P has already developed a proposal to provide additional legal support to communities and to the program.
6. In addition there is a focus on improvement of service delivery at the community level. As a part of this focus on frontline service delivery, analysis of barriers to service seeking and delivery is being undertaken and social accountability initiatives are being developed in support of local service delivery activities. This part of the position will focus on the community side of '˜governance' activities - community access to certification and identification documents and dispute resolution (supported through work on community level paralegals, and information distribution through a variety of means to community level justice and service seekers). The position will contribute to analysis and design to link paralegals work to the second component of a new activity which focuses on frontline service delivery at the Kecamatan office and, in appropriate cases, District level courts.
Duties and Accountabilities:
  • Work closely on J4Ps 'Increasing Accountability Capacity in PNPM- PNPM Justice Services' program, under the guidance of the TTL. designing the preparatory analytical work envisaged under the project; supporting the implementing agency to develop the final project design and work plan; ensuring the timely execution of a grant agreement with the implementing agency; supervising the project to ensure effective implementation and integrating lessons learned from the project into the ongoing strategy and design work being undertaken by the Indonesia J4P team. (40%)
  • Identify opportunities for improving accountability mechanisms in PNPM Rural, and develop and implement/strengthen mechanisms to do so. This will involve working closely with government to gather their ideas and gain support for proposed activities, undertaking any necessary analytical work as inputs to design, developing and maintaining relationships with government counterparts and NGO partners, supporting implementation and evaluation of activities undertaken. (20%)
  • Facilitate the design and analysis of the community-side of the second component of the Frontline Service delivery work, linking the work on community paralegals with work which aims to increase the incidence of the poor accessing birth, marriage, land and divorce certification and their access to dispute settlement. Coordinate across the various teams working on these identity and social accountability activities to ensure that they support each other as best possible, and that lessons learned are shared across teams. (30%)
  • Provide on-going support to the J4P team. This includes continued coordination with other parts of the J4P program as necessary. It may also include assistance on other J4P activities as needed. (10%)
Selection Criteria:
The selected candidate should have the following qualifications and competencies:
  • A post-graduate degree in social sciences, law or a related area;
  • A minimum of seven years experience in designing and implementing community driven development projects with a focus on access to justice and legal reform
  • Knowledge of Indonesian language and local governance/access to justice context in Indonesia would be preferable;
  • Project Management - Understands and utilizes the basic concepts of project management, as they relate to the implementation of a project. Experience in designing and working on operations involving multiple stakeholders
  • Bank Instruments, Policies, Procedures, and Systems - Fully familiar with Bank Instruments, Policies, Procedures and Systems (including safeguards, FM and procurement)
  • Portfolio Management (OS) - Analyzes and identifies portfolio cross-cutting issues; provides guidance to country/sector teams on quality of operations and portfolio performance.
  • Analytical and Technical Skills, Operational Strategy Development & Advice - Expertise in particular Bank Network recognized Sector or Theme
  • Flexibility - Able to adapt strategy, and objectives; making corresponding structural or organizational changes as needed, to move the work forward and meet the needs of the situation.
  • Independence - Able to perform duties in an objective manner, with discretion towards sensitive or confidential information.
