Background
Background:
Following Yemen’s political unrest of 2011, and the signing of the Gulf Cooperation Council peace initiative in November of that year, the Republic of Yemen has embarked on a two-year transition agenda. Against the backdrop of this political transition, and the request of the Yemeni authorities, the United Nations has articulated a Joint UN Framework to Support the Transition in Yemen, 2012-2014, which provides an important basis for UN assistance during this period. In this context, Rule of Law (RoL) has been identified as a key priority for Yemen, and for international assistance. In explicit contribution to this transition agenda, UNDP has developed a broad strategic programme of assistance in the areas of RoL, justice and security, human rights and transitional justice. The project Support to the Implementation of Transitional Justice represents one component of this overall strategic support. The overall objective of this project is to assist the Government of Yemen and other national stakeholders in developing their transitional justice initiatives based on the comprehensive approach and reflecting international standards and comparative experiences. 

The project looks to support the national TJ process from design through implementation, giving due attention to building capacity of governmental institutions and civil society and issues of communication and outreach between formal processes and national dialogue, but also to supporting various commissions of enquiry and establishment and functioning of a truth commission. The project is implemented directly by UNDP in close collaboration with OHCHR, Ministry of Legal Affairs and other key strategic stakeholders. Finally, this project will take advantage of the added value of other UN agencies and other agencies working on Transitional Justice related issues in Yemen. 

Summary of key functions

Working under overall supervision of the Governance Team Leader, direct supervision of Chief Technical Advisor-Transitional Justice and immediate coordination with the commissioners of the Commission on Forcibly Dismissed Employees, the incumbent will provide expert support to the commission to achieve its mandate. The Commission on Forcibly Dismissed Employees, together with the Commission to Consider and Address Land Issues is established in January 2013 by the presidential decree with the purpose “to address issues related to land and employees in the Sothern Governorates in order to complete the National Dialogue and National Reconciliation and as required by the Public Interest.”

 Purpose The incumbent is tasked to assist the commissioners of the Commission on Forcibly Dismissed Employees and its staff in processing and reviewing mass claims, for the purpose of achieving the commission’s mandate. 3. Objective The objective of the assignment is, by providing comparative experience and practical knowledge, to assist commissionaires and the commission’s staff in: 1) Completing the claim form and file of a claimant 2) Processing and reviewing claims (through aggregation and disaggregation)

Assisting in designing recommendations on how to settle individual and group of claims The incumbent will also, when necessary, organize individual and group training sessions for the commissionaires and the commission’s staff to assist them to achieve the commissions’ mandate.
Duties and Responsibilities
Description of responsibilities:

Scope of work Working under overall supervision of the Governance Team Leader, direct supervision of Chief Technical Advisor-Transitional Justice and immediate coordination with the commissioners of the Commission on Forcibly Dismissed Employees, the incumbent will:
  • Prepare programme concept paper of individual and group training sessions;
  • Provide, when necessary, individual and group training sessions;
  • For the purpose of organizing training sessions (logistics etc.) the consultant will closely coordinate with UNDP, in order to secure that trainings are prepared in a timely manner;
  • Prepare hand out materials for the commissioners and the commission’s staff. The consultant will closely coordinate with UNDP in order to secure that all relevant materials are shared with participants in Arabic and in timely manner;
  • Visit the commission’s sub-offices and field staff;
  • Assist commissioners and staff directly in completing and processing files;
  • Assist commissioners and staff in designing recommendations on how to settle individual and group of claims;
  • Assist the commissioners and the commission’s staff with other activities, as appropriate.
Competencies
Functional Competencies:
  • Substantial experience in completing files and processing mass claims, preferable in relation to forced dismissals.
  • Other areas may also be taken in account such as: documenting, completing and processing human rights violations’ cases; completing files and processing claims relevant to reparations activities (compensation etc.);
  • Substantial knowledge of national and international practice, policy, programme and legal documents relevant to labor law;
  • Strong managerial skills (using limited resources adequately);
  • Ability to grasp political dimensions of the context that will permeate and influence the process;
  • A collaborative work style;
  • Excellent communication skills.
Required Skills and Experience
Education:
  • Minimum university degree preferably in law, political science, international relations, social sciences, communications or other relevant degree;
  • MA and PhD is preferred, but not a must.
Experience:
  • Minimum 7 years of experience in documenting and processing mass claims in human rights and other areas. Particular attention will be paid to those experienced in issues of forced dismissals;
  • Previous experience in issues relevant to labor law highly desirable;
  • Previous experience in (related to) commissions of enquiry, truth commissions, ombudsman offices, human rights councils or similar institutions, international governmental and non-governmental organizations and domestic expert human rights NGOs desirable;
  • Previous experience in Arab countries desirable, but not a must;
  • Knowledge of transitional justice and its mechanisms desirable, but not a must.
Language:
  • Excellent knowledge of English (written and spoken) is required, but not a must;
  • Excellent knowledge of Arabic (written and spoken) is required, but not a must;
  • In case the incumbent is not skillful in Arabic, excellent knowledge of English (written and spoken) is a must.
